Judgment having been entered in the above - entitled action, and it appearing to the
satisfaction of the Court that Plaintiff Riverside Transportation Commission ( "RCTC ") has given
sufficient consideration to Defendants Gary S. Elster and Pamela C. Elster, Trustees pursuant to
that certain Declaration of Trust known as The Elster Family Trust, Dat my 30, 1976
( "Defendants ") as just compensation for all claims and demands against TC account of
RCTC's acquisition of a fee interest in certain real property located at F n ad, just
south of SR -91, at'the corner of Frontage Road and Ridgeview ace, in rona, ' erside
County, California, identified as Assessor Parcel No. 102 -092 -0 , which portions
are more particularly described in Exhibit "A," attach heret 1 d orated herein
( "Property ")
NOW, THEREFORE, IT IS HEREBY ERED the fee interest in the property
identified as Assessor Parcel No. .102- 092 -00 N 2213 described in Exhibit "A" are
condemned to RCTC as against Defendant.
IT IS FURTHER ORDERED use and purposes for which the property interests
are condemned are for public ri - o ay oses and the construction, widening, and
maintenance of SR91, loc ed in CCJ ro ve ide County, California, for the SR91 Corridor
Improvement Project, which s th etween Pierce Street on the east to the county line
on the west, in Riverside iay a, and for such other uses as -are permitted pursuant to
sections 37350.,nd 3 2 of th California Government Code and Code of Civil Procedure
sections 124. 1 2 , .125, 1240.320, and 1240.330.
I R RED that pursuant to Revenue and Taxation Code section 5082 et
seq., that a charl conditions and restrictions upon the Property being condemned in fee,
inclu ' e perty taxes, assessments, penalties and costs will be cancelled and
app ned as o June 28, 2014, the date upon or after which RCTC was entitled to take
o s ' o Property pursuant to an order for possession.
S FURTHER ORDERED that upon recording a certified copy of the Final Order of
o in the Office of the Recorder of Riverside County, California, all interests of
'D efendant in and to the Property shown and described in Exhibit "A" are hereby subject to the
