RECOMMENDED MOTION: That the Board of Supervisors adopt Resolution No. 2013 -055,
summarily vacating a portion of the restriction of Abutters' Rights of Access along Murrieta Hot
Springs Road.

BACKGROUND: As a condition of approval for Tract Map 28753 -1 within the unincorporated
territory of Riverside County, access across the southerly line of Murrieta Hot Springs Road (Lot
"A ") was restricted. The applicant, K. B. Coastal Homes, wishes to vacate the restricted access
along an existing private access easement to allow for access between said Murrieta Hot
t1� Springs Road and Tract Map 29753 -1 to the south, within the City of Temecula, which has yet to
k be fully constructed. Access is now necessary as the applicant is resuming construction

WHEREAS, the restriction of abutters' rights of access along Murrieta Hot
Springs Road was dedicated to the public by Tract Map No. 28753 -1, filed in Book
314, Pages 72 through 82, inclusive, of Maps, Records of Riverside County, California;
WHEREAS, the hereinafter- described portion of the restriction of abutters'
rights of access along Murrieta Hot Springs Road as shown on said Tract Map is no
longer necessary;
WHEREAS, applicable procedures pertaining to summary vacations were
followed pursuant to the County's adopted Resolutions for fixing procedures to vacate
and accept county highways and property offered for dedication, now therefore;

BE IT RESOLVED, DETERMINED AND ORDERED by the Board of
Supervisors of the County of Riverside, State of California, in regular session
assembled on July 30, 2
2013, as follows:
1. That the hereinafter - described portion of the restriction of abutters' rights
of access is unnecessary for present or prospective use.
SEE LEGAL DESCRIPTION AND PLAT ATTACHED HERETO
AS EXHIBITS "A" AND "B" AND MADE A PART HEREOF
2. Pursuant to Sections 8333 and 8334(a) of the Streets and Highways
Code that the hereinafter- described portion of the restriction of abutters'
rights of access is determined to be excess because it is no longer
needed and is hereby summarily vacated.
BE IT FURTHER RESOLVED, DETERMINED AND ORDERED that the Clerk
of the Board is directed to cause a certified copy of this resolution to be recorded in
the office of the Recorder of the County of Riverside, California.

LEGAL DESCRIPTION
In the County of Riverside, State of California:
Being that portion of Lot 7 of Tract No. 28753 -1 as shown by map filed in Book
314, pages 72 through 82 inclusive, of Maps, records of said Riverside County, in
Section 17, Township 7 South, Range 2 West S.B.M., described as follows:
Commencing at the Southwest corner of said Section 17;
Thence South 88'37'03" East along the southerly line of said Lot 7, a distance of
938.78 feet to the southeasterly corner of that certain parcel described in a
document entitled "Grant of Easement for Street and Agreement to Dedicate Property"
recorded December 12, 2001 as Instrument No. 2001-617484 of Official Records of
said Riverside County;
Thence North 2'48'09" East along the easterly line thereof, a distance of 17.41 feet;
Thence North 41'30'55" East, continuing along said easterly line, a distance of 29.47
feet to the northerly line of said Lot 7 and the True Point of Beginning;
Thence North 8837'03" West along said northerly line, a distance of 3.51 feet to the
