WHEREAS, highwav right of way within the county of
Riverside can: State Route 86 between State Route 86S and Avenue
59 including adjacent right of way along State Route 86 for
drainage purposes; State Route 111 between State Route 195 and
State Route 86S, and between State Route 86S and the boundary
line between the County of Riverside and the City of Coachella;
and :Mate Route 195 between State Route 86 and State Route 86S
hereinafter particularly described has been superseded by a
change in the location of said highway; and
WHEREAS, by Relinquishment Cooperative Agreement dated
November 3, 2005, Amendment 1 dated August 9, 2006, and
Ajrsendment 2 dated May 12, 2008, between the County of Riverside
and the State of California, the County waived the 90 -day notice
r+-qui j ement arid agreed to accept title to said superseded highway
arid ?lateral facilities referred to as
TRANSPORTATION COMMISSION
RESOLUTION No. R -3707
'f'.ELINQUISHED FACILITIES' in said agreements upon relinquishment
thereof to said County by the State of California; and
WHEREAS, by Resolution No. 10- 31 -06 -1, dated
October 31, 2006, the Cabazon Rand of Mission Indians approved of
the relinquishment of SR -111 from the State of California to
Riverside County for the portion that traverses the Cabazon
Reservation; and
WHEREAS, by Resolution No. TM-06-08-007, dated
June 14, _ 2 008, the Torres Martinez Desert Cahuilla Indians
approved of the relinquishment of SR -86 and SR -195 from the State
of California to Riverside County for the portions that traverse
the Torres - Martinez Reservation; and
WHEREAS, the State of California has acquired right of
way for and has constructed the above - mentioned superseded
highway said coilater.al facilities in the County of Riverside in
accordance with said agreements; and
WHEREAS, this Commission has found and determined, and
does hereby find and determine, that it is desirable and in the
public interest that said highway right of way so superseded and
said collateral facilities be relinquished to the County of
Riverside for use as county highways.
NOW, THEREFORE, IT IS VO'T'ED by the California
Transportation Commission that it relinquish, and it does hereby
relinquish, to the County of Riverside, effective upon the
recordation of a certified copy hereof with the Recorder of
Riverside County, all of the State of California's right, title:
and interest in and to said superseded highway right of way and
collateral facilities in said County, together with the right of
way and appurtenances thereof, described as follows:
All those portions of superseded highway right of way
and collateral facilities, shown as SEGMENTS 1. through 4,
inclusive, to be relinquished as indicated on one set of 10 maps
filed for record on June 20, 2008, as No. 2008 - 0339341, in State
Highway Map Book 11, Pages 91 through 100, inclusive, in the
Office of the Riverside County Recorder.
EXCEPTING AND RESERVING to the State of California any
and all rights of ingress to and egress from the Highway hereby
relinquished in and to the adjacent and adjoining freeway, except
at such points as are now or may be established by resolution of
this Commission.
THIS IS TO CERTIFY that the foregoing resolution was duly
passed by the CaliforniaTransportation Commission at its meeting
regularly called and Held on the 23' day ofJul_y 2008, in the City
of Los Angeles and that the foregoing is a full and currect copy of
the original resolutiorn. Dated this 2S 'day of July 2008.
