SUBJECT: Vacation of the "Right to Accept" a portion of 11' Street, in the Nuevo area, Fifth
Supervisorial District.
RECOMMENDED MOTION: Adopt Resolution No. 2009 -040, Vacation of the "Right to Accept"
a portion of 11 Street.
BACKGROUND: The applicant has requested that this portion of 11"' Street be vacated
because a portion of the applicant's house structure is encroaching into the 11th Street right -of-
way. The Riverside County Fire Department has no objection to the vacation, and based on
their input, the limits to be vacated are between Gibson Avenue and Converse Avenue.
Approved Tentative Tract Map No.32165 will effectively vacate the rest of 11' Street north of
Montgomery Avenue. Letters were sent to all adjacent property owners and no letters of
opposition were received. No access will be eliminated to any parcels, and the Transportation
Department has no objection to the vacation.

WHEREAS, the hereinafter - described, portion of 11'' Street, as shown on the
Map of Sierra Vista Orange Lands, filed in book 8, page 12 of maps, Records of
Riverside County, California.
WHEREAS, The offer of dedication of 11 Street has not been accepted by the
County of Riverside and; _
WHEREAS, the hereinafter - described portion of 11 Street Avenue is not
necessary and is excess Right of Way, and not required for public street or highway
purposes, now, therefore;

RESOLUTION NO. 2009-040
BE IT RESOLVED, DETERMINED AND ORDERED by the Board of
Supervisors of the County of Riverside, State of California, in regular session
assembled on April 21 , 2009, as follows;
1. Pursuant to Section 8334(x) of the Streets and Highways Code that the hereinafter -
described portion 11 Street is excess Right -of -Way, is no longer required for public
street and highway purposes and is hereby summarily vacated.
2. That the herein - described of 11 "' Street is unnecessary for present or prospective
public use, including use as a non - motorized transportation facility.
SEE LEGAL DESCRIPTION AND PLAT ATTACHED HERETO
AS EXHIBITS "A" AND "B" AND MADE A PART HEREOF
EXCEPTING AND RESERVING from the vacation an easement for any existing
public utilities and public service facilities, together with the right to maintain, operate,
replace, remove, or renew such facilities, pursuant to section 8340 of the Streets and
Highways Code.
