SUBJECT: Summarily vacating the right to accept a portion of Bain Street in the Mira Loma
area, Second Supervisorial District.
RECOMMENDED MOTION: Adopt Resolution No. 2009 -294, summarily vacating the right to
accept a portion of Bain Street in the Mira Loma area.
BACKGROUND: The applicant by design is requesting to vacate a portion of Bain Street in
conjunction with Parcel Map 32479. The condition of approval requires this resolution vacates
the required portion of Bain Street outside the boundary of the parcel map. The remaining
portion of Bain Street to be vacated between Van Buren Boulevard and Bellegrave Avenue will
be vacated by the parcel reap. The Transportation Department has reviewed the vacation and
has no objection. No access will be eliminated to any parcel.

SUMMARILY VACATING THE RIGHT TO ACCEPT A PORTION OF BAIN STREET
IN THE MIRA LOMA AREA

WHEREAS, the hereinafter - described portion of Bain Street was dedicated for
public use by the Resubdivision of Glen Avon Heights recorded in Book 10 page 100,
of maps, on file in the Office of the Recorder of Riverside County, California;
WHEREAS, the offer of dedication has not been previously accepted for public
use by the County of Riverside;
WHEREAS, the hereinafter - described portion of Bain Street is not necessary
and is excess Right of Way, and not required for public street or highway purposes,
now, therefore;
BE IT RESOLVED, DETERMINED AND ORDERED by the Board of
Supervisors of the County of Riverside, State of California, in regular session
assembled on October 6 , 2009, as follows:
1. Pursuant to Section 8334(a) of the Streets and Highways Code that
the hereinafter - described portion of Bain Street is excess Right of Way and is

3 no longer required for public street and highway purposes and is hereby
4 summarily vacated.

9 EXCEPTING AND RESERVING from the vacation an easement for any existing
10 public utilities and public service facilities, together with the right to maintain, operate,
11 replace, remove, or renew such facilities, pursuant to section 8340 of the Streets and
12 Highways Code.

14 BE IT FURTHER RESOLVED, DETERMINED AND ORDERED that the Clerk
15 of the Board is directed to cause a certified copy of this resolution to be recorded in
16 the office of the Recorder of the County of Riverside, California.

That portion of Parcel 1 of Lot Line Adjustment 3260, in the Unincorporated Territory of
the County of Riverside, State of California, as shown on Exhibit "B" attached to that
certain document recorded May 16, 1991 as Instrument No. 91- 164268 of Official
Records, in the office of the County Recorder of said County, also lying in Section 9,
Township 2 South, Range 6 West, San Bernardino Meridian, described as follows:
'Beginning at the Northeast corner of said Parcel 1;
Thence South 0'51'17" West 666.75 feet along the Easterly line of said Parcel 1 to the
Northeast corner of Parcel 2 of said Lot Line Adjustment 3260;
Thence leaving said Easterly line North 79 °41'55" West 25.34 feet along the Southerly
line of said Parcel 1 to a line parallel with and 25.00 feet Westerly of said Easterly line of
Parcel 1;
