RECOMMENDED MOTION: Adopt Resolution No. 2008 -005, summarily vacating a portion of
Post Road.
BACKGROUND: The'two affected property owners have requested the vacation of a portion of
Post Road. One of the Property Owners has a modular home that was inadvertently built in the
Public Right -of -Way of Post Road. To help solve this problem the Department of Transportation
has agreed to the re- alignment of this portion of Post Road increasing the radius of the curve
and creating a safer road condition. This portion of Post Road is no longer required due to the
dedication and acceptance of the new alignment.

9 WHEREAS, the hereinafter - described Post Road was dedicated on Parcel Map
10 18550, Book 112, Page 50 and 51, of Parcel Maps, on file in the Office of the
11 Recorder of Riverside County, California;

13 WHEREAS, the hereinafter - described Post Road is not necessary and is
14 excess Right of Way, and not required for public street or highway purposes, now,
15 therefore;

17 BE IT RESOLVED, DETERMINED AND ORDERED by the Board of
18 Supervisors of the County of Riverside, State of California, in regular session
19 assembled on July 15 , 2008, as follows:

21 1. Pursuant to Section 8334(x) of the Streets and Highways Code that
22 the hereinafter - described Post Road is excess Right of Way and is no .longer
23 required for public street and highway purposes and is hereby summarily
24 vacated.

AS EXHIBITS WAND WAND MADE A PART HEREOF
EXCEPTING AND RESERVING from the vacation an easement for any existing
public utilities and public service facilities, together with the right to maintain, operate,
replace, remove, or renew such facilities, pursuant to section 8340 of the Streets and
Highways Code.
2. That the herein - described Post Road is unnecessary for present or
prospective public use, including use as a non - motorized transportation facility.
BE IT FURTHER RESOLVED, DETERMINED AND ORDERED that the Clerk
of the Board is directed to cause a certified copy of this resolution to be recorded in
the office of the Recorder of the County of Riverside, California.
