RECOMMENDED MOTION: Adopt Resolution No. 2008 -006, accepting the Declaration of
Dedication for public road and utility purposes, but not into the County Maintained Road
System, Fifth Supervisorial District.
BACKGROUND: The requesting property owner lives along a portion of Post Road, which was
dedicated and accepted for vesting title with the recording of Parcel Map 18550. Inadvertently a
modular home was built in the dedicated right of way of Post Road. To resolve this issue the
Department of Transportation has agreed to a re- alignment of this portion of Post Road
increasing the radius of the curve and creating a safer road condition. Subsequently, one of the
requirements also included accepting a portion of the Declaration of Dedication.

ACCEPTING FOR PUBLIC USE A PORTION OF THE DECLARATION OF
DEDICATION RECORDED MAY 5, 1975, AS INSTRUMENT NUMBER 51603, IN THE
GOOD HOPE AREA.

WHEREAS, the hereinafter - described Declaration of Dedication irrevocably dedicates
for Public Road and Utility purposes, but previously not accepted for public use by the County
of Riverside, now, therefore;
BE IT RESOLVED, DETERMINED AND ORDERED by the Board of Supervisors of
the County of Riverside, State of California, in regular session assembled on July 15
2008, that this Board accepts the offers of dedication and recognizes that said road is public
road open for use by the general public;
BE IT FURTHER RESOLVED, DETERMINED, AND ORDERED that this acceptance
is for the purpose of vesting title in the County of Riverside on behalf of the public for public
road and utility uses, and is not an acceptance of the roads into the County Maintained Road
System pursuant to Section 941 of the Streets and Highways Code and that said road will not

3 become part of the County Maintained Road System unless subsequently accepted into said
4 Maintained Road System by a resolution adopted by this Board, said road is in the County of
5 Riverside, State of California; and is described as follows:

8 All that portion of Post Road (88.00 feet wide) dedicated by Instrument No. 51603
9 recorded on May 5, 1975, Official Records of Riverside County, California, lying within Parcel
10 3 of Parcel Map No. 6802, recorded on November 10, 1975 in Book 20 of Parcel Maps, page
11 4, Official Records of Riverside County, California; excepting all that portion lying within Lot
12 "A" of said Parcel Map.

14 BE IT FURTHER RESOLVED that the Clerk of the Board shall cause a certified copy
15 of this resolution to be recorded in the Office of the County Recorder of Riverside County,
16 California.
