SUBJECT: Accepting a portion of 16 Avenue for public road and utility purposes, in the
Desert Hot Springs area, Fourth Su ervisorial District.
RECOMMENDED MOTION: Adopt Resolution No. 2008-271, accepting a portion of 16th
Avenue for public road and utility purposes, but not into the County Maintained Road System.
BACKGROUND: The applicant for CUP 3485 has requested the acceptance of this road
easement in order to have sufficient accepted public right of way to install the road
improvements as required by the condition of approval.

9 WHEREAS, the hereinafter- described portion of 16"' Avenue as shown on Record of
10 Survey hereinafter - referred to, has not been accepted for public use by the County of
11 Riverside, now, therefore;

13 BE IT RESOLVED, DETERMINED AND ORDERED by the Board of Supervisors of
14 the County of Riverside, State of California, in regular session assembled on September 2 ,
15 2008, that this Board accepts the above mentioned road and recognizes that said road is a
16 public road open for use by the general public;

18 BE IT FURTHER RESOLVED, DETERMINED, AND ORDERED that this acceptance is for
19 the purpose of vesting title in the County of Riverside on behalf of the public for public road
20 and utility uses, and is not an acceptance of this road into the County Maintained Road
21 System pursuant to Section 941 of the Streets and Highways Code and that said road will
22 not become part of the County Maintained Road System unless subsequently accepted into
23 said Maintained Road System by a resolution adopted by this Board;
24 Said road is in the County of Riverside, State of California, and is described as follows:

All that portion of 16 Avenue (30.00 feet wide) as shown on Record of Survey
recorded in Book 22 page 25, Records of Riverside County, California.
BE IT FURTHER RESOLVED that the Clerk of the Board shall cause a certified copy of this
resolution to be recorded in the Office of the County Recorder of Riverside County, California.
