RECOMMENDED MOTION: Adopt Resolution No. 2008 -441, summarily vacating portions of
Patton Avenue and Rice Road and authorize the Chairman to execute the Quitclaim Deed, in
the Winchester area.
BACKGROUND: The property owners abutting these portions of Patton Avenue and Rice Road
have requested this vacation. These portions of Patton Avenue and Rice Road are no longer
required due to the new alignment of Newport Road now known as Domenigoni Parkway.
Domenigoni Parkway was built to an urban arterial highway standard, which limits access at
quarter mile intervals. These existing roads do not meet the existing standards.
The portions of Patton Avenue and Rice Road to be vacated are owned in fee title by the
County of Riverside. The County will be quitclaiming the fee portions to the adjacent property
owners. The County was deeded a new alignment of Domenigoni Parkway, which is of greater
width and value than the existing easements. The Transportation Department notified the
adjacent property owners and has not received any letters in opposition to this vacation_ This
vacation will not eliminate access to any parcel.

WHEREAS, the hereinafter- described portions of Patton Road and Rice Road
were dedicated and accepted for public road and utility purposes per deed recorded
December 7, 1 922 in Book 544 of Deeds at page 194 and Parcel Map 16456,
recorded in Parcel Map Book 111 page 36 , Recorder of Riverside County, California;
WHEREAS, the hereinafter- described portion of Patton Avenue and Rice Road
are not necessary and are excess Right of Way, and not required for public street and
highway purposes, now, therefore;
BE IT RESOLVED, DETERMINED AND ORDERED by the Board of
Supervisors of the County of Riverside, State of California, in regular session
assembled on December 23 , 2008, as follows:
1. Pursuant to Section 8334(a) of the Streets and Highways Code that
the hereinafter- described portions of Patton Avenue and Rice Road
are excess Right of Way and are no longer required for public street
and highway purposes and are hereby summarily vacated.

Highways Code.

unnecessary for present or prospective public use, including use as a non -
motorized transportation facility.
