7 FROM THE RIVERSIDE COUNTY WASTE RESOURCES MANAGEMENT DISTRICT

9 BE IT RESOLVED AND DETERMINED by the Local Agency
10 Formation Commission in regular session assembled on February
11 22, 2007, that the reorganization of approximately 10 acres,
12 generally located south of Avenue 42, north of Fred Waring
13 Drive, east of Washington Street and west of Sheehan Drive as
14 more particularly described in Exhibit "A ", attached hereto and
15 made a part hereof is approved.
16 BE IT FURTHER RESOLVED, DETERMINED AND FOUND that:
17 1. Commission proceedings were commenced by
18 Petition of Trans West Housing, landowner.
19 2. The reorganization is proposed to provide
20 municipal services by the City of La Quinta.
21 3. The distinctive short form designation of the
22 proposal is LAFCO No. 2006- 1 36 - 4- Reorganization to Include
23 Concurrent Annexation 17 to the City of La Quinta, and the La
24 Quinta Lighting and Landscaping District No. 89 -01 and
25 Detachments from the Riverside County Waste Resources
26 Management District.
27 4. The City of La Quinta, as lead agency has
28 adopted the Environmental Impact Report (EIR) prepared for the

2 of Dete7mination and that the Commission has reviewed the
3 environmental documentation.
4 5. The boundaries of the territory as set forth
5 in Exhibit "A ", attached hereto and incorporated herein by this
6 reference are approved.
7 7. The territory to be reorganized is legally
8 uninhabited.
9 8. This reorganization is consistent with the
10 spheres of influence of the City of La Quinta and the spheres
11 of• influence of all other affected local agencies.
12 9 . The reorganization is approved subject to the
13 following terms and conditions:
14 a. The City shall defend, indemnify, and hold
15 harmless the Riverside County Local Agency Formation Commission
16 ( "LAFCO "), its agents, officers, and employees from any claim,
17 actions, or proceedings against LAFCO, its agents, officers,
18 and employees to attach, set aside, void, or annul an approval
19 of LAFCO concerning this proposal.
20 b. In accordance with Government Code Sections
21 56886 (t) and 57330, the subject territory shall be subject to
22 the levying and collection of any previously authorized charge,
23 fee, assessment or tax of the City.
24 C. The City of La Quinta shall annex the territory
25 included in this reorganization into the La Quinta Lighting and
26 Landscaping District No. 89-01. 27 10. In accordance with Government Code Section
28 56375(p), waive automatic detachment from County Service Area

1 152 based upon the following findings:
2 i. County Service Area (CSA) 152 is a funding
3 mechanism for the implementation of the national Pollutant
4 Discharge Elimination System (NPDES} emanating from the Federal
5 1972 Clean water Act, and re- authorized under the Federal 1987
6 Clean Water Act,
7 ii. The City annexed into CSA 152 and is
8 included within the CSA's service area.
9 iii. Detachment would deprive the area
10 residents services needed to ensure their health, safety or
11 welfare.
12 iv. Waiving detachment will not affect the
13 ability of the City to provide any services.
14 11. Pursuant to Section 56663(c), waive protest
15 proceedings and make the following determinations:
16 a. The affected territory is legally
17 uninhabited.
18 b. All owners of land in the affected
19 territory have consented to the proposal.
20 12. The Executive Officer is directed to prepare
21 and execute a Certificate of Completion upon receipt of fees
22 required by Government Code Section 54902.5 (made payable to
23 the State Board of Equalization).
