8 WHEREAS, proceedings have been initiated pursuant to
9 the Cortese -Knox- Hertzberg Local Government Reorganization Act
10 of 2000, commencing with Section 56000 of the California
ill Government Code, for reorganization of 505 acres of land
12 located south of Berry Road, west of Wood Road, north of John
13 F. Kennedy Drive and east of Chicago Avenue as more
14 particularly described in Exhibit "A ", attached hereto and made
15 a part hereof, and
16 WHEREAS, the short form designation of the proposal
17 is LAFCO No. 2006 - 109 -1-- Reorganization to Include Annexation 97
1$ to the City of Riverside, Concurrent Detachments from County
19 Service Area 113 and the Riverside County Waste Resources
20 Management District and Detachment.
21 WHEREAS, the Local Agency Formation Commission of
22 Riverside County adopted Resolution No. 09 -07 on January 25,
23 2007, approving the reorganization, and
24 WHEREAS, by LAFCO Resolution No. 44 -01, the
25 Commission has delegated authority over all conducting
26 authority functions to the Executive Officer; and
27 WHEREAS, Resolution 09 -07 directed the Executive
28 Officer to commence protest proceedings pursuant to Part 4 of

1 the Cortese - Knox - Hertzberg Local Government Reorganization Act
2 of 2000, commencing with Section 57000; and
3 WHEREAS, the Executive Officer of the Local Agency
4 Formation Commission acting on behalf of the Commission as the
5 conducting authority, held a properly noticed public hearing on
6 this matter on Wednesday, March 7, at 9:00 a.m. at 3850 Vine
7 Street, Suite 110, Riverside, California, and
8 WHEREAS, the Executive Officer has found that the
9 value of the written protests filed and not withdrawn was less
10 than 25 percent of the registered voters within the affected
11 area and less than 25 percent of the number of owners of land
12 owning 25 percent of the assessed value of land within the
13 affected territory in accordance with Government Code Section.
14 57075(a).
15 WHEREAS, the terms and conditions of the proposal as
16 approved by the Local Agency Formation Commission are as
i7 follows:
18 a. In accordance with Government Code Sections
19 56886(t) and 57330, the subject territory shall be subject to
20 the levying and collection of any previously authorized charge,
21 fee, assessment or tax of the City.
22 b. The City of Riverside shall defend, indemnify and
23 hold harmless the Riverside County Local Agency Formation
24 Commission (LAFCO), its agents, officers, and employees from
25 any claim, action, or proceeding against LAFCO, its agents,
26 officers, and employees to attach, set aside, void, or annul an
27 approval of LAFCO concerning this proposal.

I 56375(n), waive automatic detachment from County Service Area
2 152 based upon the following findings:
3 i. County Service Area (CSA) 152 is a funding
4 mechanism for the implementation of the National Pollutant
5 Discharge Elimination System (NPDES) emanating from the Federal
6 1972 Clean Water Act, and re- authorized under the Federal 1987
7 Clean Water Act.
8 ii. The City of Riverside annexed into CSA 152
9 and is included within the CSA`s service area.
10 iii. Detachment would deprive the area
11 residents services needed to ensure their health, safety or
12 welfare.
13 iv. Waiving detachment will not affect the
14 ability of the City to provide any services.
15 WHEREAS, the reason for this proposed annexation is
16 to provide municipal services by the City of Riverside, and
17 WHEREAS, the regular County assessment roll is
18 utilized by the subject agencies; and
19 WHEREAS, the Commission determined the territory
20 proposed to be reorganized is legally inhabited.
21 WHEREAS, the affected territory will be taxed for
22 existing general bonded indebtedness of this City; and
23 NOW, THEREFORE, BE IT RESOLVED that the Executive
24 Officer, on behalf of the Local Agency Formation Commission,
25 pursuant to the Cortese - Knox - Hertzberg Local Government
26 Reorganization Act of 2000, orders the reorganization of the
27 territory described in Exhibit "A" to include Annexation 97 to
