05- ANX -03 TO THE CITY OF BEAUMONT AND CONCURRENT DETACHMENTS
FROM COUNTY SERVICE AREA 152 AND THE RIVERSIDE COUNTY WASTE
RESOURCES MANAGEMENT DISTRICT

zd BE IT RESOLVED AND DETERMINED by the Local Agency
10 Formation Commission in regular session assembled on December
11 7, 2006, that the reorganization of approximately 6.5 acres,
12 generally located south of Norman Avenue, east of Orchard
13 Heights Avenue, west of Bellflower Avenue, and north of 17
14 Avenue as more particularly described in Exhibit "A ", attached
15 hereto and made a part hereof is approved.
16 BE IT FURTHER RESOLVED, DETERMINED AND FOUND that:
17 1. Commission proceedings were commenced by
18 Pecuniary Capital, LLC, sole landowner.
19 2. The reorganization is proposed to provide
20 municipal services by the City of Beaumont.
21 3. The distinctive short form designation of the
22 proposal is LAFCO No. 2006- 106- 5- Rearganization to Include
23 Annexation No. 05- ANX -03 to the City of Beaumont and Concurrent
24 Detachments from County Service Area 152 and the Riverside
25 County Waste Resources Management District.
26 4. The City of Beaumont, as lead agency, has
27 adopted a Negative Declaration for the annexation area and made
28 a de minimis finding regarding impacts to wildlife resources

pursuant to Section 711.4 of the Fish and Game Code.
5. The boundaries of the territory as set forth in
Exhibit "A" attached hereto and incorporated herein by this
4 reference, have been approved.
5 6. The territory to be reorganized is legally
6 uninhabited.
7. The reorganization is approved subject to the
following terms and conditions:
a. In accordance with Government Code Sections
10 56886 (t) and 57330, the subject territory shall be subject to
11 the levying and collection of any previously authorized charge,
12 fee, assessment or tax of the City.
13 b. The City of Beaumont, shall defend, indemnify
14 and hold harmless the Riverside Local Agency Formation
15 Commission (LAFCO), its agents, officers, and employees from
16 any claim, action, or proceeding against LAFCO, its agents,
17 officers, and employees to attach, set aside, void, or annul an
18 approval of LAFCO concerning this proposal.
19 8. Pursuant to Government Code Section 56663(c),
20 waive protest proceedings and make the following
21 determinations:
a. The affected territory is legally uninhabited_
b. The proposal has the support of 100% of the
affected landowners.
25 11 9. The Executive Officer is directed to prepare
26 and execute a Certificate of Completion upon receipt of fees
27 required by Section 54902.5 (made payable to the State Board of
28 Equalization).
