4 ORDERING REORGANIZATION TO INCLUDE CONCURRENT ANNEXATION "76
5 TO THE CITY OF SAN JACINTO AND DETACHMENT FROM THE RIVERSIDE
6 COUNTY WASTE RESOURCES MANAGEMENT DISTRICT
7 LAFCO NO. 2005 -71-3
8 WHEREAS, proceedings have been initiated pursuant to
9 the Cortese - Knox - Hertzberg Local Government Reorganization Act
10 of 2000, corrmencing with Section 56000 of the California
11 Government Code, for reorganization of approximately 50 acres
12 located south of the Ramona Expressway, west of Vernon Avenue,
13 north of Cypress Avenue and east of Alessandro Avenue; and
14 WHEREAS, the short form designation of the proposal
15 is LAFCO No. 2005 -71 -3- Reorganization to Include Concurrent
16 Annexations to the City of San Jacinto and Detachment from the
17 Riverside County Waste Resources Management District, and
18 WHEREAS, the Local Agency Formation. Commission of
1g Riverside County adopted Resolution No. 83--05 on December 8,
20 2005, approving the Reorganization as described and depicted in
21 Exhibit "A" attached hereto and by this reference incorporated
22 herein; and
23 WHEREAS, by LAFCO Resolution No. 44 -01, the
24 Commission has delegated authority over all conducting
25 authority functions to the Executive Officer; and
26 WHEREAS, by LAFCO Resolution No. 83 -05, the
27 Commission authorized the Executive Officer to proceed with
28 Conducting Authority Proceedings, without notice, hearing or

2 WHEREAS, the terms and conditions of the proposal as
3 approved by the Local Agency Formation Commission are as
4 follows:
5 a. The City of San Jacinto shall defend,
6
7 indemnify, and hold harmless the Riverside County Local Agency
Formation Commission ( "LAFCOO), its agents, officers, and
8 employees from any claim, actions, or proceedings against
9 LAFCO, its agents, officers, and employees to attach, set
10 aside, void, or annul an approval of LAFCO concerning this
11 proposal.
12 - b. In accordance with Government Code Section
13 56886 (t) and 57330, the subject territory shall be subject to
14 the levying and collection of any previously authorized charge,
15 fee, assessment or tax of the City and the district.
16 C. In accordance with Government Code Section
17 56375(n), waive automatic detachment from County Service Area
18 152 based upon the following findings:
19 i. County Service Area (CSA) 152 is a Funding
20 mechanism for the implementation of the National Pollutant
21 Discharge Elimination System (NPDES) emanating from the Federal
22 1972 Clean water Act, and re- authorized under the Federal 1987
23 Clean Water Act.
24 ii. The City annexed into CSA 152 and is
25 included within the GSA's service area.
26 iii. Detachment would deprive residents
27 services needed to ensure their health, safety or welfare.
28 iv. Waiving detachment will not affect the

ability of the City to provide any service.
WHEREAS, the reason for this proposed reorganizatinn
is to provide municipal services by the City of San Jacinto.
WHEREAS, the regular County assessment roll is
5 utilized by the City of San Jacinto.
6 WHEREAS, the Commission determined the territory
7 proposed to be reorganized is legally uninhabited as defined in
8 Government Code Section 56046; and
9 WHEREAS, the affected territory will be taxed for
10 existing general bonded indebtedness of the subject agencies.
11 NOW, THEREFORE, BE IT RESOLVED that the Executive
12 Officer on behalf of the Local Agency Formation Commission
13 pursuant to the Cortese - Knox - Hertzberg Focal Government
14 Reorganization Act of 2000 orders the reorganization of the
15 territory described in Exhibit "A" to Include Annexation 76 to
16 the City of San Jacinto and Detachment from the Riverside
17 County Waste Resources Management District,
18 BE IT FURTHER RESOLVED that the Executive Officer
19 shall complete this proposal pursuant to State Law subject to
20 payment of required fees and terms and conditions as approved
2 by the Commission.
