5 101 TO THE CITY OF CORONA AND DETACHMENT FROM THE RIVERSIDE
6 COUNTY WASTE RESOURCES MANAGEMENT DISTRICT
7 LAFCO NO. 2005 -77 -2
8 WHEREAS, proceedings have been initiated pursuant to
9 the Cortese - Knox - Hertzberg Local Government Reorganization Act
10 of 2000, commencing with Section 56000 of the California
11 Government Code, for reorganization of 320 acres of land
12 located south of Green River Road, west of Adobe Avenue, north
13 of the Cleveland National Forest and east of Bulrush Circle as
14 more particularly described in Exhibit "A ", attached hereto and
15 made a part hereof, and
16 WHEREAS, the short form designation of the proposal
17 is LAFCO No. 2005 - 77 -2- Reorganization to Include Concurrent
18 Annexation 101 to the City of Corona and Detachment from the
19 Riverside County Waste Resources Management District, and
20 WHEREAS, the Local Agency Formation Commission of
21 the County of Riverside adopted Resolution No. 84 -05 on
22 December 8, 2005, approving the Reorganization, and
23 WHEREAS, the reorganization is proposed to improve
24 service boundaries.
25 WHEREAS, by LAFCO Resolution No. 44 - 01, the
26 Commission has delegated authority over all conducting
27 authority fund -oz;s to the Executive Officer; and

1 the Executive Officer to proceed with Conducting Authority
2 Proceedings, without notice, hearing or election; and
3 WHEREAS, the terms and conditions of the proposal as
4 approved by the Local Agency Formation Commission are as
5 follows:
6 a. The City of Corona shall defend, indemnify and
7 hold harmless the Riverside County Local Agency Formation
g Commission (LAFCO), its agents, otficers, and employees from
9 any claim, action, or proceeding against LAFCO, its agents,
10 officers, and employees to attach, set aside, void, or annul an
11 approval of LAFCO concerning this proposal_
12 b. In accordance with Government Code Section
13 56886(t) and 57330, the subject territory shall he subject to
14 the levying and collection of any previously authorized charge,
15 fee, assessment or tax of the City.
16 C. Prior to recardatiorz of a Certificate of
17 Completion, the City Manager shall, by letter to the Riverside
1g LAFCO Executive Officer, confirm that all city required fees,
19 conditions and acceptance into all required maintenance
20 districts of the City have been completed by the applicant and
21 are acceptable to the City of Corona.
22 d. In accordance with Government Code Section
23 56375(p), waive automatic detachment from County Service Area
24 152 based upon the following findings:
25 i. County Service Area (CSA) 152 is a funding
26 mechanism for the implementation of the National Pol�.utant
27 Discharge Elimination System (NPDES) emanating from the Federal
28 1972 Clean Water Act, and ref- authorized u-zder the Federal 75

iii. Detachment would deprive the area
residents services needed to ensure their health, safety or
welfare.
iv. waiving detachment will not affect the
9 ability of the City to provide any services.
10 WHEREAS, the Commission determined the territory
11 proposed to be reorganized is legally uninhabited.
12 WHEREAS, the affected territory will be taxed for
13 existing general bonded indebtedness of this City; and
14 NOW, THEREFORE, BE IT RESOLVED that the Executive
15 officer, on behalf of the Local Agency Formation Commission,
16 pursuant to the Cortese - Knox- Hertzberg Local Government
17 Reorganization. Act of 2000, orders the reorganization of the
1$ territory described in Exhibit "A" to include Annexation 101 to
19 the City of Corona and Detachment from the Riverside County
Waste Resource Management District.
21 BE IT FURTHER RESOLVED that the Executive Officer
22 shall complete this proposal pursuant to State Law subject to
