WHEREAS, the hereinafter- described portion of Cumming Avenue was
10
dedicated for public road and utility purposes on the Tract Map of Romola No. 5,
11
recorded in Map Book 14, Pages 44 through 46, inclusive, Official Records of the
12
Recorder of Riverside County, California; and,
13

WHEREAS, the offer of dedication for said portion of Cumming Avenue has not
15
been accepted for public use by the County of Riverside; and,
16

WHEREAS, the hereinafter- described portion of Cumming Avenue is not
18
necessary and is excess Right of Way, and not required for public street and highway
19
purposes, now, therefore;

BE IT RESOLVED, DETERMINED AND ORDERED by the Board of
22
Supervisors of the County of Riverside, State of California, in regular session
23
assembled on June 20 , 2006, as follows:

I RESOLUTION NO. 2006
1. Pursuant to Section 8334(x) of the Streets and Highways Code that
the hereinafter - described portion of Cumming Avenue is excess Right
of Way and is no longer required for public street and highway
purposes and is hereby summarily vacated.
SEE LEGAL DESCRIPTION AND PLAT ATTACHED HERETO
AS EXHIBITS "A" AND "B" AND MADE A PART HEREOF
EXCEPTING AND RESERVING from the vacation an easement for any existing
public utilities and public service facilities, together with the right to maintain, operate,
replace, remove, or renew such facilities, pursuant to section 8340 of the Streets and
Highways Code.
2. That the herein - described portion of Cumming Avenue is unnecessary for
present or prospective public use, including use as a non - motorized
transportation facility.
BE IT FURTHER RESOLVED, DETERMINED AND ORDERED that the Clerk
of the Board is directed to cause a certified copy of this resolution to be recorded in
the office of the Recorder of the County of Riverside, California.
