4 ORDERING REORGANIZATION OF TERRITORY TO INCLUDE ANNEXATIONS
5 TO THE CITY OF BEAUMONT (No. 05- ANX -05) AND THE BEAUMONT
6 CHERRY - VALLEY WATER DISTRICT AND CONCURRENT DETACHMENTS FROM
7 THE RIVERSIDE COUNTY WASTE RESOURCES MANAGEMENT

10 WHEREAS, proceedings have been initiated pursuant to
11 the Cortese - Knox -- Hertzberg Local Government Reorganization. Act
12 of 2000, commencing with Section 56000 of the California
13 Government Code, for reorganization of 30 acres of land located
14 south of the City of Beaumont south of Mellow Lane and west of
15 Manzanita Park Road as more particularly described in Exhibit
16 as more particularly described in Exhibit "A ", attached hereto
17 and made a part hereof, and
18 WHEREAS, the short form designation of the proposal
19 is LAFCO No. 2005- 105 -5- Reorganization to Include Concurrent
20 Annexations to the City of Beaumont (No. 05-- ANX -05) and the
21 Beaumont Cherry - Valley Water District and Concurrent
22 Detachments from the Riverside County Waste Resources
23 Management District and CSA 152, and
24 WHEREAS, the Local Agency Formation Commission of
25 Riverside County adopted Resolution No. 32 -06 on April 27,
26 2006, approving the Reorganization, and
27 WHEREAS, the reorganization is proposed to improve
28 service boundaries.

1 WHEREAS, by LAFCO Resolution No. 44 -01, the
2 Commission has delegated authority over all conducting
3 authority functions to the Executive Officer; and
4 WHEREAS, Resolution 32 --06, the Commission authorized
5 the Executive Officer to proceed with Conducting Authority
6 Proceedings, without notice, hearing or election; and
7 WHEREAS, the terms and conditions of the proposal as
g approved by the Local Agency Formation Commission are as
Q follows:
10 a. In accordance with Government Code Section
11 56886(t) and 57330, the subject territory shall be subject to
12 the levying and collection of any previously authorized charge,
13 fee, assessment or tax of the City and the District.
i4 b. The City of Beaumont and the Beaumont Cherry -
15 Valley Water District shall defend, indemnify and hold harmless
16 the Riverside County Local Agency Formation Commission (LAFCO),
17 its agents, officers, and employees from any claim, action, or
1g proceeding against LAFCO, its agents, officers, and employees
19 to attach, set aside, void, or annul an approval of LAFCO
20 concerning this proposal.
21 WHEREAS, the regular County assessment roll is
22 utilized by the City of Beaumont, but not by the Beaumont
23 Cherry Valley Water District.
24 WHEREAS, the Commission determined the territory
25 proposed to be reorganized is legally uninhabited.
26 WHEREAS, the affected territory will not be taxed
27 for existing general. bonded indebtedness of this City; and
28 NOW, THEREFORE, BE TT RESOLVED that the Executive

That portion of the southerly 50 acres of the west one -half of the northeast quarter of fractional Section
15, township 3 south, range 1 west, Records of Riverside County, said portion described as follows:
Commencing at a point in the centerline intersection of California Avenue and Mellow Lane said point
also being the northwest corner of said fractional Section 15;
THENCE along the northerly line of said Section 15, said line also being the southerly boundary line of
the City of Beaumont and the centerline of Mellow Lane, South 89 °32'10" East a distance of 1320.19 feet
to a point, said point being the northwest corner of the northeast'/ of said Section 15, said point also
being the centerline intersection of Manzanita Park Road and Mellow Lane;
