9 BE IT RESOLVED AND DETERMINED by the Local Agency
iQ Formation Commission in regular session assembled on August 3,
11 2006, that the reorganization of approximately 36 acres,
12 generally located south of State Highway 60, east of ,Tack
13 Rabbit Trail, west of Lamb Canyon Road and north of the north
14 section line of Section 18 and 17, T3S R1W as more particularly
15 described in Exhibit "A ", attached hereto and made a part
16 hereof is approved.
17 BE IT FURTHER RESOLVED, DETERMINED AND FOUND that:
18 1. Commission proceedings were commenced by CRV -SC
19 Beaumont Partners, LP.
20 2. The reorganization is proposed to provide
21 municipal services by the City of Beaumont.
22 3. The distinctive short form designation of the
23 proposal is LAFCO No. 2006 - 44 - 5- Reorganization to Include
24 Annexation 05- ANX -04 to the City of Beaumont and Concurrent
25 Detachment from County Service Area 152 and the Riverside
26 County Waste Resources Management District.
27 4. The City of Beaumont, as lead agency, for the
28 reorganization, under the California Environment Quality Act

1 (CEQA), has prepared and certified an Addendum to the
2 Environmental Impact Report for the Hidden Canyon Specific
3 Plan. As part of the certification of the EIR, the City
4 adopted findings of fact and statement of overriding
5 considerations concerning various potential environmental
6 impacts associated with implementation of the proposal.
7 5. The City complied with CEQA and all
8 appropriate State Guidelines, and the Commission has reviewed
9 and considered the environmental documentation and adopts the
10 Findings of Fact that are included in the City's Resolution
11 1995 -26 certifying the EIR.
12 6. The boundaries of the territory as set forth in
13 Exhibit "A" attached hereto and incorporated herein by this
14 reference, have been approved.
15 7. The territory to be reorganized is legally
16 uninhabited.
17 8. The reorganization is approved with modified
1$ boundaries subject to the following terms and conditions:
19 a. In accordance with Government Code Sections
20 56886 (t) and 57330, the subject territory shall be subject to
21 the levying and collection of any previously authorized charge,
22 fee, assessment or tax of the City and the District.
23 b. The City of Beaumont, shall defend, indemnify
24 and hold harmless the Riverside Local Agency Formation
25 Commission (LAFCO), its agents, officers, and employees from
26 any claim, action, or proceeding against LAFCO, its agents,
27 officers, and employees to attach, set aside, void, or annul an
2$ approval of LAFCO concerning this proposal.
