INDIO AND CONCURRENT DETACHMENTS FROM THE RIVERSIDE COUNTY

WASTE RESOURCES MANAGEMENT DISTRICT

WHEREAS, proceedings have been initiated pursuant to
9
the Cortese -Knox- Hertzberg Local Government Reorganization Act
10
of 2000, commencing with Section 56000 of the California
11
Government Code, for reorganization of 783 acres of land
12
located east of Adams Avenue and ,Sun City Palm Desert,
13
southwest of the Indio Hills, and north of Avenue 38 in the
14
northwest corner of Indio's SCI as more particularly described
15
in Exhibit "A ", attached hereto and made a part hereof, and
16
WHEREAS, the short form designation of the proposal
17
is LAFCO No. 200 - 63 - 4 - Reorganization to Tnclude Annexation 82
18
to the City of Indio and Concurrent Detachments from the
19
Riverside County Waste Resources Management District, and
20
WHEREAS, the Local Agency Formation Commission of
21
Riverside County adopted Resolution No. 82 -05 on December 8,
22
2005, approving the Reorganization, and
23
WHEREAS, by LAFCO Resolution No. 44 -01, the
24
Commission has delegated authority over a i conducting
25 authority functions to the Executive Officer; and
26
WHEREAS, Resolution 82 -05 directed the Executive
27 Officer to co=ience protest proceedings pursuan -- to Part 4 of
28 the Cortese - Knox- Hertzherg Local Government Reorganization Act

2 WHEREAS, the Executive Officer of the Local Agency
3 Formation Commission acting on behalf of the Commission as the
4 conducting authority, held a properly noticed public hearing on
5 this matter on Tuesday, February 21, 2005, at 9:00 a.m. at 3850
6 Vine Street, Suite 110, Riverside, California, and
7 WHEREAS, the Executive Officer has found that the
8 value of the written protests filed and not withdrawn was less
9 than 50 percent of the assessed value of land within the
10 affected territory in accordance with Government Code Section
11 5.7075(b).
12 WHEREAS, the terms and conditions of the proposal as
13 approved by the Local Agency Formation Commission are as
14 follows:
15 a. In accordance with Government Code Sectio -ns
16 56886(t) and 57330, the subject territory shall be subject to
17 the levying and collection of any previously authorized charge,
18 fee, assessment or tax of the City.
19 b. The City of Indio shall defend, indemnify and
2Q hold harmless the Riverside County Local Agency Formation
21 Commission (LAFCO), its agents, officers, and Employees from
22 any claim, action, or proceeding against LAFCO, its agents,
23 officers, and employees to attach, set aside, void, or annul an
24 approval of LAFCO concerning this proposal.
25 C - Prior to the recordation of the Certificate of
26 Completion, a complete application must be submitted for
27 annexation to "_he Civy of the pocket area south of the subject
28 annexation within_ the City's S01, as depicted in Exhibit S.

I d. Prior to the recordation of a Certificate of
2 Completion, the City of Indio shall enter into an agreement
3 with the County of Riverside, relative to the same area
4 identified in condition 4c above, to:
5 i) Provide maintenance to all county maintained
6 roads beginning 2 years from the date of
7 recordation of the Certificate of Completion,
8 ii) Provide police protection services and
9 iii) Assume responsibility for fire protection if
10 the contract with the County /CDC' is
11 terminated.
12 iv) Provide assurance that if a fire station is
13 not constructed within the annexation area,
14 the $3 million in -leu payment from the
15 developer to the City will be expended to
16 support fire protection_
17 Such agreement shall remain in effect until one of the
18 following occur:
19 i) The area referred to in condition 4c, is
2 0 annexed;
21 ii) LAFCO rejects such annexation application;
22 iii) Such annexation is terminated by majority
28 protest or election, or
24 iv) Until the agreement is terminated by both
25 parties.
26 WHEREAS, the reason for this proposed annexation is
27 to provide municipal services by the City of Indio, and
28 WHEREAS, the regular County assessment roll. is

utilized by the subject agencies; and

WHEREAS, the Commission determined the territory
3
proposed to be reorganized is legally uninhabited as defined in
4
Government Code Section 56046; and
5
WHEREAS, the affected territory will not be taxed
6
for existing general bonded indebtedness of this City; and
7
NOfr1, THEREFORE, BE IT RESOLVFD that the Executive
8
Officer, on behalf of the Local Agency Formation Commission,
9
pursuant to the Cortese- Knox -- Hertzberg Local Government
10
Reorqanization Act of 2000, orders the reorganization of the
11
territory described in Exhibit "A" to include Annexation 82 to
12
the City of Indio and Concurrent Detachments from the Riverside

County Waste Resources Management District subject to the terms
14
and conditions herein.
15
BE IT FURTHER RESOLVED that the Executive Officer
16
shall complete this proposal pursuant to State Law subject to
17
terms and conditions as approved by the Commission.
