4 APPROVING THE PROPOSED REORGANIZATION TO INCLUDE
5 .ANNEXATION 110 TO THE CITY OF RIVERSIDE, DETACHMENT FROM THE
6 RIVERSIDE COUNTY WASTE RESOURCES MANAGEMENT DISTRICT
7 LAFCO NO. 2006 -100 -2
8 BE IT RESOLVED AND DETERMINED by the Local Agency
9 Formation Commission in regular session assembled on September
10 28, 2006, that the reorganization of approximately 29 acres,
11 generally located south of Indiana Avenue, west of Pierce
12 Street, north of Sun Summit drive and east of Buchanan Street
13 as more particularly described in Exhibit "A ", attached hereto
14 and made a part hereof is approved.
15 BE IT FURTHER RESOLVED, DETERMINED AND FOUND that:
16 1. Commission proceedings were commenced by Alvord
17 Unified School District.
18 2. The reorganization is proposed to annex the
19 remaining area of their new High School #4 so that development
20 will take place in a single governmental jurisdiction.
21 3. The distinctive short form designation of the
22 proposal is LAFCO No. 2 006 - 10D --2- Reorganization to Include
23 Annexation 110 to the City of Riverside, and Detachment from
24 Riverside County Waste Resources Management District.
25 4. The City of Riverside, as lead agency, has
?6 filed a Negative Declaration on the proposal and complied with
7 the California Environmental Quality Act (CEQA) and all
!8 appropriate State Guidelines, and that the Commission has

1 reviewed and considered the environmental documentation.
2 5. The City has found that the proposal will not
3 have an adverse effect on wildlife resources, as defined -in.
4 Section 711.2 of the Fish and Game Code;
5 6. The boundaries of the territory as set forth
$ in Exhibit "A ", attached hereto and incorporated herein by this
7 reference are approved.
8 7. The territory to be reorganized is legally
9 uninhabited, there being fewer than 12 registered voters
10 residing within the boundaries of the proposal.
11 8. This reorganization is consistent with the
12 spheres of influence of the City of Riverside and the spheres
13 of influence of all other affected local agencies.
14 9. The reorganization is approved subject to the
15 following terms and conditions:
16 a. The City shall defend, indemnify, and hold
17 harmless the Riverside County Local Agency Formation Commission
18 ( "LAFCO "), its agents, officers, and employees from any claim,
19 actions, or proceedings against LAFCO, its agents, officers,
20 and employees to attach, set aside, void, or annul an approval
21 of LAFCO concerning this proposal.
22 b. In accordance with Government Code Sections
23 56886 (t) and 57330, the subject territory shall be subject to
24 the levying and collection of any previously authorized charge,
25 fee, assessment or tax of the City.
�6 C. In accordance with Government Code Section
'7 56375(n), waive automatic detachment from County Service Area
!8 152 based upon the following findings:

I i. County Service Area (CSA) 152 is a funding
2 mechanism for the implementation of the national Pollutant
3 Discharge Elimination System (NPDES) emanating from the Federal
4 1972 Clean Water Act, and re- authorized under the Federal 1987
5 Clean Water Act.
6 ii. The City annexed into CSA 152 and is
7 included within the CSA's service area.
8 iii. Detachment would deprive the area
9 residents services needed to ensure their health, safety or
10 welfare.
11 iv. Waiving detachment will not affect the
12 ability of the City to provide any services.
13 11. Pursuant to Section 56663(c), waive protest
14 proceedings and make the following determinations:
15 a. The affected territory is legally
16 uninhabited.
17 b. The proposal has the consent. of 100% of
18 the affected landowners.
19 12. The Executive Officer is directed to prepare
2 0 and execute a Certificate of Completion upon receipt of fees
21 required by Government Code Section 54902.5 (made payable to
22 the State Board of Equalization)
