9 BE IT RESOLVED AND DETERMINED by the Vocal Agency
10 Formation Commission in regular session assembled on ,September
11 28, 2006, that the reorganization of approximately 17 acres,
12 generally located south of the Santa Ana River, northeast of
13 Montrose Avenue and north of Ramona Expressway as more
14 particularly described in Exhibit "A ", attached hereto and made
fr a part hereof is approved.
16 BE IT FURTHER RESOLVED, DETERMINED AND FOUND that:
17 1. Commission proceedings were commenced by the
18 City of San Jacinto.
19 2. The reorganization is proposed to provide
20 municipal services by the City of San Jacinto.
21 3. The distinctive short form designation of the
22 proposal is LAFCO No. 2006 -74 -3- Reorganization to Include
23 Annexation 77 to the City of San Jacinto and Concurrent
24 Detachment from Riverside County Waste Resources Management

I has complied with the provisions of the California
2 Environmental Quality Act (CEQA) and all appropriate State
3 Guidelines.
4 5. The City has found that the proposal will not
5 have an adverse effect on wildlife resources, as defined in
6 Section 711.2 of the Fish and Game Code;
7 6. The boundaries of the territory as set forth
8 in Exhibit `lA ", attached hereto and incorporated herein by this
9 reference are approved.
10 7. The territory to be reorganized is legally
11 uninhabited.
i S. This reorganization is consistent with the
13 spheres of influence of the City of San Jacinto and the spheres
14 "of influence of all other affected local agencies.
15 9. The reorganization is approved subject to the
16 following terms and conditions:
17 a. In accordance with Government Code Sections
18 56886 (t) and 57330, the subject territory shall be subject to
19 the levying and collection of any previously authorized charge,
20 fee, assessment or tax of the City.
21 b. The City shall defend, indemnify, and hold
22 harmless the Riverside County Local, Agency Formation Commission
23 ( "LAFCO "), its agents, officers, and employees from any claim,
24 actions, or proceedings against LAFCO, its agents, officers,
25 and employees to attach, set aside, void, or annul an approval
26 of LAFCO concerning this proposal.
27 C. In accordance with Government Code Section
28 56375(n), waive automatic detachment from County Service Area

1 152 based upon the following findings:
2 i . County Service Area (CSA) 152 is a funding
3 mechanism for the implementation of the National Pollutant
4 Discharge Elimination System (NPDES) emanating from the Federal
5 1972 Clean Water Act, and re- authorized under the Federal 1987
6 Clean Water Act.
7 ii. The City annexed into CSA 152 and is
8 included within the C5A's service area.
9 iii. Detachment would deprive the area
10 residents services needed to ensure their health, safety or
11 welfare.
12 iv. Waiving detachment will not affect the
13 ability, of the City to provide any services_
14 10. Pursuant to Section 56663(c), waive protest
15 proceedings and make the following determinations:
16 a. The affected territory is legally
17 uninhabited.
18 b. All owners of land in the affected
19 territory have consented to the proposal.
20 11. The Executive Officer is directed to prepare
21 and execute a Certificate of Completion upon receipt of fees
22 required by Government Code Section 54902.5 (made payable to
23 the State Board of Equalization).

That certain real property in the Unincorporated Territory of the County of Riverside,
State of California, described as follows:
Being the northwesterly rectangular one -half of Wood Lot "E" and Wood Lot "F ", both
in Section 23, Township 4 South, Range 1 West, San Bernardino Meridian, as shown on
Partition Map of Rancho San Jacinto Viejo, made under decree of the Superior Court of
the State of California, in and for the County of San Diego, dated. November 22, 1882 in
Case No. 227 of said Court, more particularly described as follows:
Beginning at the most westerly corner of said Wood Lot "F ", said point also being an
angle point in the easterly boundary of Farm Lot 107 of the lands of the San Jacinto Land
Association as shown by map filed in Book 8, Page 357 of Maps, records of said County
of San Diego, also being an angle point in the easterly boundary line of Annexation No.
64 to the City of San Jacinto;
