SUBJECT: Summarily vacating a portion of restricted access along Lakepointe Drive, in the
Lake Hills area, First Supervisorial District.
RECOMMENDED MOTION:' That the Board adopt Resolution No. 2005 -411, summarily
vacating a portion of restricted abutters rights of access along Lakepointe Drive.
BACKGROUND: This vacation of restricted access has been requested in order to provide
an access opening to Lot 45 of Tract 23140, for the construction of a single family residence.

9 WHEREAS, the restricted abutters rights of access along Lakepointe Drive was
10 dedicated to the County by Tract Map 23140, recorded in Map Book 214, Pages 40
11 through 45, inclusive, Official Records of the Recorder of Riverside County, California;

13 WHEREAS, the hereinafter - described portion of restricted abutters right of
14 access for Lot 45 of said tract map is necessary to provide access; now, therefore;

16 BE IT RESOLVED, DETERMINED AND ORDERED by the Board of
17 Supervisors of the County of Riverside, State of California, in regular session
18 assembled on September 13 , 2005, as follows:

20 1. Pursuant to Section 8334(a) of the Streets and Highways Code that
21 the hereinafter- described portion of restricted abutters rights of access
22 is needed for access and is hereby summarily vacated.

unnecessary for present or prospective public use, including use as a non -
motorized transportation facility.
BE IT FURTHER RESOL IED, DETERMINED AND ORDERED that the Clerk
of the Board is directed to cause a certified copy of this resolution to be recorded in
the office of the Recorder of the County of Riverside, California.

LEGAL DESCRIPTION OF VACATION OF RESTRICTED ACCESS RIGHTS
ALONG LAKEPOINTE DRIVE
Being that portion of the restricted access rights on Lot 45 as shown by the reap of Tract 23140
recorded in Book 214 pages 40 through 45, inclusive, of Maps, Official Records of Riverside County,
California, in Section 26, Township 3 South, Range 6 West, S.B.M. described as follows.
Beginning at point on the northwesterly right of way line of Lakepointe Drive, 66 feet wide as
shown by said map of Tract 23140, said point being distant thereon, South 50 °21'58" West 193.04 feet from
the northeast corner of said Lot 45.
Thence along said right of way line of Lakepointe Drive, South 50 °21'58 "West20.00 feet to the
point of terminus.
The above described vacation of access rights are shown on sketch marked Exhibit A, attached
hereto.
