SUBJECT: General vacation and vacation of the right to accept all public roads within the La Cresta
Property Owners Association and designated roads adjacent thereto, in the La Cresta area, First
Supervisorial District.
RECOMMENDED MOTION: Adopt Resolution No_ 2004 -042, General vacation and vacation of the
right to accept all public roads within the La Cresta Property Owners Association and designated
roads adjacent thereto, in the La Cresta area, First Supervisorial District.

BACKGROUND: The La Cresta Property Owners Association has requested the vacation of all the
roads within their boundaries and the designated roads adjacent to their boundaries. This vacation
will enable the La Cresta Property Owners Association to create a private gated community and
allow the association to contract out for law enforcement.
The roads included in this vacation have not been improved to County standards and are not
County maintained. These roads have been dedicated to public use, but most of them have not
been accepted for public use. The La Cresta Property Owners Association maintains roads within
their boundaries and will continue to do so. The La Cresta Property Owners Association has
executed agreements with adjacent property owners and property owner associations addressing
their concerns regarding access issues.
Transportation Department staff mailed 676 ballots to property owners within the La Cresta
Property Owners Association and received 242 responses in favor of the vacation and 50 responses
against the vacation. Ballots were also mailed to 165 property owners who would be affected by the
vacation and are adjacent to the La Cresta Property Owners Association, we received 23 responses
in favor of the vacation and 15 against the vacation.
The Planning Commission recommended approval of this vacation at their November 19, 2003
public hearing. The Transportation Department does not object to this vacation.

WHEREAS, pursuant to Streets and Highways Code Section 8321, a petition has been
filed with the Board of Supervisors of the County of Riverside, State of California, requesting
the general vacation and vacation of the right to accept all public roads in the La Cresta
Property Owners Association and designated roads adjacent thereto, in the La Cresta area
of the County of Riverside, California; and,
WHEREAS, the Riverside County Planning Commission, in regularsession assembled
I on November 19, 2003, recommended approval of said General vacation; and,
WHEREAS, Resolution No. 2004 -041 has been duly published and posted pursuant
Ito the rovisions of the Streets and Highways Code; and

WHEREAS, a public hearing has been conducted and the Board of Supervisors of the
County of Riverside has heard all of the evidence offered by all persons interested in the
matter; and,

WHEREAS, the Board of Supervisors has determined that the herein- described roads
are not part of the circulation element of the General Plan and are unnecessary for present
or prospective public use;
BE IT RESOLVED, DETERMINED AND ORDERED by the Board of Supervisors of the
County of Riverside, State of California, in regular session assembled on February 24 ,2004,
that the hereinafter - described roads are no longer required for public street and highway
purposes and, pursuant to Section 8334(a) of the Streets and Highways Code, shall hereby
be vacated:
SEE LEGAL DESCRIPTION AND PLAT ATTACHED HERETO
AS EXHIBITS "A" AND "B" AND MADE A PART HEREOF
EXCEPTING AND RESERVING from the vacation, an easement for any existing public
utilities and public service facilities, together with the right to maintain, operate, replace,
remove, or renew such facilities, pursuant to section 8340 of the Streets and Highways Code.
BE IT FURTHER RESOLVED, DETERMINED AND ORDERED that the Clerk of the
Board is directed to cause a certified copy of this resolution to be recorded in the office of the
Recorder of the County of Riverside, California. /1
