the dedication of a portion of Weirick Road.

BACKGROUND: This portion of Weirick Road was dedicated for a 44 foot half- width, resulting in an
88 foot full -width road right of way. In this location a 60 foot full width, 30 foot half width right of way is
the current requirement. The abutting property owner is requesting the vacation of the excess 14 feet
of the right of way. The Transportation Department has no objection to this vacation.

SUMMARILY VACATING THE RIGHT TO ACCEPT THE DEDICATION OF A PORTION
OF WEIRICK ROAD
IN THE TEMESCAL CANYON AREA

WHEREAS, the hereinafter - described portion of Weirick Road was dedicated for
public use by declaration of dedication recorded as Instrument No. 132632, on October 15,
1974, and shown on Parcel Map 5547, recorded in Parcel Map Book 16, Page 55, records
of the Recorder of Riverside County, California, and,
WHEREAS, the offer of dedication for said portion of Weirick Road has not been
accepted for public use by the County of Riverside; and,
WHEREAS, the hereinafter- described portion of Weirick Road is excess right -of-
way, is not required for public street or highway purposes, and this vacation will not
eliminate access to any parcels; now, therefore,
BE IT RESOLVED, DETERMINED AND ORDERED by the Board of Supervisors of
the County of Riverside, State of California, in regular session assembled on June 15
2004, as follows:
1. That the hereinafter - described portion of Weirick Road is not required for public
street and highway purposes and is, pursuant to Section 8334(a) of the Streets and
Highways Code, hereby summarily vacated:

AS EXHIBIT "A" AND MADE A PART HEREOF
EXCEPTING AND RESERVING from the vacation an easement for any existing
public utilities and public service facilities, together with the right to maintain, operate,
replace, remove, or renew such facilities, pursuant to section 8340 of the Streets and
Highways Code.
2. That the herein- described portion of Weirick Road is unnecessary for present or
prospective public use, including use as a non - motorized transportation facility.
BE IT FURTHER RESOLVED, DETERMINED AND ORDERED that the Cleric of the
Board is directed to cause a certified copy of this resolution to be recorded in the office of
the Recorder of the County of Riverside, California.

Legal description of vacation of 14.00 feet of existing right of way as shown on Parcel
Map 5547 recorded in Book 16 page 55 of Parcel Maps lying in Section 2 Township 4
South, Range 6 West on file in the office of the County Recorder, Riverside California.
Commencing at a point in the North Line of Parcel 2 of said map, said point also being
on the Center Line of an unnamed road (later named Weirick Road) 44.00 foot hail width
as shown on said map;
Thence N87 0 13'45 "E along said North Line a distance of 36.04 feet to a point on a curve
and the TRUE POINT OF BEGINN NG;
Thence leaving said North Line, southwesterly on a curve concave northwesterly having
a radius of 370 feet through a central angle of 00 °07'44" an arc distance of 0.83 feet, a
radial line through said point bears N59 °14'44"W;
Thence S30 °53' 00 "W, a distance of 69.14 feet to the beginning of a tangent curve,
concave easterly having a radius of 470.00 feet;
