RECOMMENDED MOTION: Adopt Resolution No. 2004237, summarily vacating the right to accept
the dedication of a portion of an Unnamed Road.
BACKGROUND: The two property owners abutting this portion of the Unnamed Road have
requested this vacation. The property owners would like to fence this area, landscape it and keep
the weeds and trash from accumulating. This portion of the road is unused and is not needed for
access. The other adjacent property owners have been notified of this vacation request and they do
not object.

WHEREAS, the hereinafter - described portion of an Unnamed Road was dedicated for
public use by declaration of dedication recorded as Instrument No. 26860, on March 7, 1974,
and shown on Parcel Map 5746, recorded in Parcel Map Book 12, Page 10, records of the
Recorder of Riverside County, California, and,
WHEREAS, the offer of dedication for said portion of an Unnamed Road has not been
accepted for public use by the County of Riverside; and,
WHEREAS, the hereinafter - described portion of an Unnamed Road is excess right -of-
way, is not required for public street or highway purposes, and this vacation will not eliminate
access to any parcels; now, therefore,
BE IT RESOLVED, DETERMINED AND ORDERED by the Board of Supervisors of the
County of Riverside, State of California, in regular session assembled on June 22 , 2004,
as follows:
1. That the hereinafter - described portion of an Unnamed Road is not required for public
street and highway purposes and is, pursuant to Section 8334(a) of the Streets and Highways
Code, hereby summarily vacated:

SEE LEGAL DESCRIPTION AND PLAT ATTACHED HERETO
AS EXHIBITS "A" AND °B" AND MADE A PART HEREOF
EXCEPTING AND RESERVING from the vacation an easement for any existing public
utilities and public service facilities, together with the right to maintain, operate, replace,
remove, or renew such facilities, pursuant to section 8340 of the Streets and Highways Code.
2. That the herein - described portion of an Unnamed Road is unnecessary for present
or prospective public use, including use as a non - motorized transportation facility.
BE IT FURTHER RESOLVED, DETERMINED AND ORDERED that the Clerk of the
Board is directed to cause a certified copy of this resolution to be recorded in the office of the
Recorder of the County of Riverside, California.

That portion of Declaration of Dedication recorded on March 7, 1974, as Instrument No.
26860, Official Records of Riverside County, State of California, being in section 26,
Township 3 South, Range 5 West S.B.B.M., being more particularly described as
follows:
Commencing at the southwest corner of parcel 2 of Parcel Map 5746,on file in parcel
map book 12, page 10, Official Records of said County, said point also being on the west
line of said declaration of dedication;
Thence along the west line of said lot 2 and said declaration of dedication, N00 °20'50 "W
a distance of 44.92 feet;
Thence leaving said west lines N 89 39'10'T, a distance of 30.00 feet to a point on a
line parallel to and distant 30.00 feet easterly as measured at right angles to said west
lines, said point also being an angle point in said declaration of dedication and the True
Point of Beginning;
Thence S00° 20'50 "E along said parallel line a distance of 90.00 feet to an angle point on
