SUMMARILY VACATING PALM LEAF COURT AND A PORTION
OF THE RESTRICTED ABUTTER'S RIGHTS
OF ACCESS ALONG VARNER ROAD, IN THE RANCHO MIRAGE AREA

WHEREAS, the hereinafter - described Palm Leaf Court (Lot C), and restricted abutter's
rights of access along Varner Road, were dedicated for public road use to the County, by Parcel
Map 28514, recorded in Book 194, Pages 3 and 4, of Parcel Maps, Records of the County of
Riverside,
WHEREAS, the offers of dedication for said Palm Leaf Court, and said restricted
abutter's rights of access along Varner Road, have been accepted for public use by the County
of Riverside, and as part of the County maintained road system; and
WHEREAS, these vacations will not eliminate access to any parcels, are excess right of
way, are not required for public street or highway purposes, and are excess interest; now
therefore,
BE IT RESOLVED, DETERMINED AND ORDERED, by the Board of Supervisors
of the County of Riverside, State of California, in regular session assembled on,
November 9 , 2004, as follows;
1. That pursuant to section 8334(a) of the Streets and Highways Code, the hereinafter-

described Palm Leaf Court and the hereinafter - described portions of the restricted abutters
rights of access are not required for public street and highway purposes, are excess right of way,
and are hereby summarily vacated;
EXCEPTING AND RESERVING from the vacations, any easement for any existing
public utilities and public service facilities, together with the right to maintain, operate, replace,
remove or renew such facilities, pursuant to Section 8340 of the Streets and Highways Code.
2. That the herein- described Palm Leaf Court and portions of the restricted abutters
rights of access are unnecessary for present or prospective public use, including uses as non -
motorized transportation facilities;
Said road and said portions of restricted abutter's rights of access are in the County of
Riverside, State of California, and are described as follows:
