RECOMMENDED MOTION: That the Board adopt Resolution No. 2003 -122, General
vacation of all roads within the Lake Skinner View Estates boundaries, in the Lake
Skinner area, Third Supervisorial District.
BACKGROUND: The Lake Skinner View Estates Home Owners Association is asking
for the vacation of all roads within the Lake Skinner View Estates Boundaries for the
purpose of having a gated community to increase security. There will be no detrimental
impact on traffic patterns. There will be no landlocked parcels as a result of this
vacation. Twenty -one (21) adjacent landowners have been notified of the vacation, by
certified mail, twenty (20) responded in favor of the vacation, one (1) did not respond.
The Metropolitan Water District owns several parcels within the Lake Skinner View
Estates and most of the property surrounding it and are in favor of the vacation. Said
vacation was presented to the Planning Commission on February 19, 2003. The
Planning commission recommended approval.

9 WHEREAS, the hereinafter- described roads within the Lake Skinner View
10 Estates boundaries were dedicated and accepted for public road purposes by Parcel
11 Map 14733 recorded in book 90, pages 94 through 102, inclusive, records of the
12 Recorder, Riverside County, California,
13
14 WHEREAS, pursuant to Streets and Highways Code Section 8321, a petition
15 has been filed with the Board of Supervisors of the County of Riverside, State of
16 California, requesting the general vacation of roads offered for dedication which are
17 located within the Lake Skinner View Estates boundaries in the Lake Skinner area of
18 the County of Riverside; and,

20 WHEREAS, on , 2003, the Board of Supervisors of the County
21 of Riverside duly and regularly adopted Resolution No. 2003 -121, giving notice of
22 intention to vacate all roads within the Lake Skinner View Estates boundaries; and,

3 WHEREAS, Resolution No. 2003 -121 has been duly published, posted and
4 mailed pursuant to the provisions of the Streets and Highways Code; and,
5
s WHEREAS, pursuant to Streets and Highways Code Section 2381 the Board
7 of Supervisors of the County of Riverside has determined that the highways offered
8 for dedication as described herein are not useful as non - motorized transportation
9 facilities; and,
10
11 WHEREAS, a public hearing has been conducted and the Board of
12 Supervisors of the County of Riverside has heard all evidence offered by all persons
13 interested in the matter; and,
14
15 WHEREAS, the Board of Supervisors of the County of Riverside has
16 determined that the highways described herein are excess right -of -way and
17 unnecessary for present or prospective public use; now, therefore,
18
19 BE IT RESOLVED, DETERMINED AND ORDERED by the Board of
20 Supervisors of the County of Riverside, State of California, in regular session
21 assembled on May 13 , 2003, that pursuant to Section 8334(x) of the Streets and
22 Highways Code, the County of Riverside hereby vacates all roads within the Lake
23 Skinner View Estates boundaries, being in the County of Riverside, State of
24 California, more particularly described as follows:

SEE LEGAL DESCRIPTION AND PLAT ATTACHED HERETO
AS EXHIBITS "A" AND "B" AND MADE A PART HEREOF
EXCEPTING AND RESERVING from the vacation easements for any existing
public utilities and public service facilities, together with the right to maintain, operate,
replace, remove, or renew such facilities, pursuant to section 8340 of the Streets and
Highways Code.
BE IT FURTHER RESOLVED, DETERMINED AND ORDERED that the Clerk
of this Board shall cause a certified copy of this resolution to be recorded in the Office
of the Recorder of Riverside County, California.
