RECOMMENDED MOTION:
That the Board adopt Resolution No. 2000 -117, summarily vacating the right to
accept the dedication of a 60 foot unnamed road easement.

.JUSTIFICATION:
The 60 foot unnamed road easement was a requirement per the conditions of
approval for Tract 23629. The 60 foot unnamed road easement was temporary until
a permanent road was built. The needed road is now built. This vacation will not
eliminate access to any parcels.

SUMMARILY VACATING THE RIGHT TO ACCEPT
THE DEDICATION OF A 60 FOOT UNNAMED EASEMENT
IN THE TEMECULA AREA

(THIRD SUPERVISORIAL DISTRICT)
WHEREAS, the herein -after described unnamed 60 foot road easement was dedicated
to the County per Tract Map 23629, recorded in Book 263, Pages 39 through 46, records of
the County Recorder, Riverside County, California, and,
WHEREAS, the offer of dedication for said unnamed 60 foot road easement has not
been accepted by the County of Riverside; and,
WHEREAS, said unnamed 60 foot road easement is not part of the circulation element
of the General Plan, and that this vacation will not eliminate access to any parcels, and is
excess right of way, and not required for public street or highway purposes; now, therefore,
BE IT RESOLVED, DETERMINED AND ORDERED by the Board of Supervisors of
the County of Riverside, State of California, in regular session assembled on
May 9 , 2000, as follows:
1. That the right to accept the hereinafter described portion of said 60 foot unnamed
road easement is excess right of way not required for public street and highway purposes and
is pursuant to Section 8334(a) of the Streets and Highways Code, hereby summarily vacated:

SEE LEGAL DESCRIPTION ATTACHED HERETO
AS EXHIBIT W AND "B" AND MADE A PART HEREOF
EXCEPTING AND RESERVING from the vacation an easement
for any existing public utilities and public service'facilities, together
with the right to maintain, operate, replace, remove or renew such
facilities, pursuant to Section 8340 of the Streets and Highway Code.
2. That the herein - described 60 foot unnamed road easement is unnecessary for
present or prospective public use, including use as a non- motorized transportation facility. j
BE IT FURTHER RESOLVED, DETERMINED AND ORDERED that the Clerk of this
Board is directed to cause a certified copy of this resolution to be recorded in the Office of the
County Recorder of the County of Riverside, California.
