SUBJECT: Summarily vacating Aldergate Drive, in the Menifee area, Third Supervisorial
District
RECOMMENDED MOTION:
That the Board adopt Resolution No. 2000 -92, summarily vacating Aldergate Drive.
JUSTIFICATION:
Aldergate Drive has been removed from Riverside County's General Plan
Circulation Study Area 6 by General Plan Amendment CGPA 473. The vacation will
permit Aldergate Drive to become a gated private street, as proposed by the
Conditions of Approval for Tract 28996. Aldergate Drive is proposed to be the
primary access for the Ryland Homes senior community. There are four additional
points of access that will be provided as unmanned card -gated entrances. The
proposed gated entrances will be provided with Knox systems for emergency
purposes. The Homeowners Association for the Oasis at Menifee will own and
maintain that vacated portion of Aldergate Drive. Transportation and the Fire
Department are in favor of this vacation.

SUMMARILY VACATING ALDERGATE DRIVE,
IN THE MENIFEE AREA
(AB00002)
(THIRD SUPERVISORIAL DISTRICT)
WHEREAS, the hereinafter described Aldergate Drive, was dedicated per Parcel Map
21838, recorded in Book 146, Pages 1 through 26, inclusive, records of the County Recorder,
Riverside County, California, and,
WHEREAS, the hereinafter- described portion of Aldergate Drive is not part of the
circulation element of the General Plan, and that this vacation will not eliminate access to any
parcels, and is excess right -of -way, and not required for public street or highway purposes:
now therefore,
BE IT RESOLVED, DETERMINED AND ORDERED by the Board of Supervisors of
the County of Riverside, State of California, in regular session assembled on
June 6 , 2000, as follows:
1. Pursuant to Section 8334(a) of the Streets and Highways Code the hereinafter
described Aldergate Drive is excess right -of -way not required for public street and highway
purposes and is hereby summarily vacated:

3 EXCEPTING AND RESERVING from the vacation any easement for any existing

5 replace, remove or renew such facilities, pursuant to Section 8340 of the Streets and
6 Highways Code.

8 2. That the herein - described Aldergate Drive is unnecessary for present or
9 prospective public use, including use as a non - motorized transportation facility.

11 BE IT FURTHER RESOLVED, DETERMINED AND ORDERED that the Clerk of this
12 Board shall cause a certified copy of this resolution to be recorded in the Office of the County
13 Recorder of the County of Riverside, California.

ALDERGATE DRIVE VACATION
IN THE COUNTY OF RIVERSIDE
All of Lot "A" of Tract 25259 -1 as recorded in Book 283, Pages 54 through 59 inclusive of Maps, all of
Lot "A" of Tract 28996 -1 as recorded in Book 286, Pages 11 through I3 inclusive of Maps, a portion of
Lot "B" of Tract 25258 as recorded in Book 281, Pages 33 through 36 inclusive of Maps; and those
portions of Parcels 14,,1$, 19, 22 and 23 of Parcel Map 21838 as shown in Book 146, Pages 1 through 26
inclusive of Parcel Maps, all records of Riverside County, Califomia, described as follows:
A strip of land, 88,00 feet in width, the centerline of said strip being described as follows:
Conunencing at Point "A" as described in Road Easement to the County of Riverside recorded on
July 13, 1990 as Instrument number 259801. Said point also being .the intersection of Aldergate
Drive and Menifee Road as shown on said Tract Map No. 25258;
Thence North 73°21'05" West, 419.73 feet along the centerline of Aldergate Drive as shown on
said Tract map No. 25258, to the beginning of a tangent curve concave Southerly having a radius
of 1350.00 feet; thence Westerly 59.82 feet along said curve through a central angle of 2 °32'20" to
the True Point of Beginning.
Thence continuing along said curve and said centerline Westerly 727.56 feet along said curve
through a central angle of 33 °25' 03 "to a point on the centerline of AIdergate Drive, as shown on
said Tract Map No. 25259 -1;
Thence along said centerline South 73 °13'52" West, I174.33 feet to the beginning of a tangent curve concave
Southeasterly having a radius of 3000.00 feet;
Thence Southwesterly 1141.43 feet along said curve through a central angle of 21 °47'59'; .
Thence South 51 1 25'53" West, 746.86 feet along the Aldergate Drive centerline as shown on said
Parcel Map 21838 to a point distant South 51 °25'53" West 388.80 feet from the most Northerly
corner of said Parcel 19, said point being the beginning of a tangent curve concave Northerly
having a radius of 1350.00 feet;
Thence along said centerline Westerly 1561.31 feet along said curve through a central angle of
