RECOMMENDED MOTION: Thai tl a Board adopt Resolution No. 2000 -168 , summarily vacating a portion of restricted abutters rights of access along Highland Home Road. JUSTIFICATION: Existing driveway entrance can not be built because of a flood plain. In order to enable the property owner to build his driveway a portion of the restricted abutters rights of access - must be vacated in order to facilitate the new entrance. i David E. Deputy 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 BOARD OF SUPERVISORS COUNTY OF RIVERSIDE RESOLUTION NO 2000 -168 SUMMARILY VACATING A PORTION OF RESTRICTED ABUTTERS RIGHTS OF ACCESS ALONG HIGHLAND HOME ROAD, IN THE BANNING AREA (AB- 2000 -14) (THIRD SUPERVISORIAL DISTRICT) WHEREAS, the restricted abutters rights of access along Highland Home Road was established by the recording of Parcel Map 13521, in Book 83, pages 13 through 15 inclusive, records of the Recorder, Riverside County, California; and, WHEREAS, the hereinafter - described portion of restricted abutters rights of access for Parcel 7 of said map is not necessary and is excess interest. BE IT RESOLVED, DETERMINED AND ORDERED by the Board of Supervisors of the County of Riverside, State of California, in regular session assembled on JUNE 20 , 2000, as follows: 1. Pursuant to Section 8334(a) of the Streets and Highways code that the hereinafter described abutters restricted rights of access is an excess interest in the named right -of -way that is not required for highway purposes and is hereby summarily vacated: Irl Ill 111 111 1 U RESOLUTION NO. 2000 -168 r 2 3 4 5 6 7 8 9 10 11 12 13 14 15 HIGHLAND HOME ROAD One thirty foot wide (30.00) access opening along Highland Home Road (100.00' wide) as shown on PM 13521, recorded in Book 83, pages 13 through 15 inclusive of Parcel Maps, records of the Recorders Office, Riverside County, CA. The centerline of said thirty foot wide opening, being along the westerly right -of -way line of said Highland Home Road and fifteen (15.00) feet northerly of the southeasterly comer of parcel 7, as shown on said PM 13521. SEE ATTACHED EXHIBIT "A" 2. That the herein described portion of the County Highway is unnecessary for present or prospective public use, including use as a non - motorized transportation facility.
