RECOMMENDED MOTION: That the Board adopt Resolution No. 2000 -158, Vacation of a portion of Albion Lane, in the Menifee area. JUSTIFICATION: The vacation of that portion of Albion Lane is a condition of Tentative Tract 29234. The design of Tentative Tract Map 29234 is reliant upon the vacation, which will permit the incorporation of the southerly portion of Albion Lane into Lots 1 through 10 of the Tentative Tract map. The vacation is contingent upon the dedication, without improvements, of a County Standard Knuckle at the intersection of Albion Lane and Palomar Road. Deputy 111 Board of Supervisors County of Riverside I 21 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2000 -158 GENERAL VACATION OF A PORTION OF ALBION LANE IN THE MENIFEE AREA (AB99018) (THIRD SUPERVISORIAL DISTRICT) WHEREAS, pursuant to Street and Highways Code Section 8321, a petition has been filed with the Board of Supervisors of the County of Riverside, State of California, requesting the general vacation of a portion of Albion Lane which is located in the Menifee area of the County of Riverside; and, WHEREAS, on July is , 2000, the Board of Supervisors of the County of Riverside duly and regularly adopted Resolution No. 2000 -157, giving notice of intention to vacate a portion of Albion Lane, and, WHEREAS, Resolution No. 2000 -157 has been duly published, posted and mailed pursuant to the provisions of the Street and highways Code; and, WHEREAS, pursuant to Streets and Highways Code Section 2381 the Board of Supervisors of the County of Riverside has determined that Albion Lane as described hereon is not useful as a non - motorized transportation facility; and, WHEREAS, a public hearing has been conducted and the Board of Supervisors of the County of Riverside has heard all of the evidence offered by all persons interested in the matter; and, WHEREAS, the Board of Supervisors of the County of Riverside has determined that the highway described herein is excess right -of -way and unnecessary for present public use; now therefore, 11 IN 2 of 7 1 2 3 4 5 6 7 S 9 10 11 12 13 14 151 161 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 2000 -158 BE IT HEREBY RESOLVED, DETERMINED AND ORDERED by the Board of Supervisors of the County of Riverside, State of California, in regular session assembled on August 15 1 2000, that pursuant to Section 8334(a) of the Streets and Highways Code, the County of Riverside hereby vacates a portion of Albion Lane, being in the County of Riverside, State of California, more particularly described as follows: SEE LEGAL DESCRIPTION AND PLAT ATTACHED HERETO AND MADE A PART HEREOF EXCEPTING AND RESERVING from the vacation an easement for any existing public utilities and public service facilities, together with the right to maintain, operate, replace, remove, or renew such facilities, pursuant to Section 8340 of the streets and Highways Code. BE IT FURTHER RESOLVED, DETERMINED AND ORDERED that the vacation of that portion of Albion Lane is contingent upon the dedication, without improvements, of a County Standard Knuckle at the intersection of Albion Lane and Palomar Road.
