RECOMMENDED MOTION:
That the Board adopt Resolution No. 2000 -118, summarily vacating a portion of
Davis Road.

JUSTIFICATION:
The Metropolitan Water District of Southern California recently completed the
installation of an underground water line, on Davis Road, as part of the Inland
Feeder Project. The water line was constructed within the existing traveled way,
which is not within the dedicated right -of -way of Davis Road.
The State of California, acting by and through the Department of Fish and Game
Wildlife Conservation Board, has dedicated the new alignment of that portion of
Davis Road to the County._ _
This vacation will eliminate the excess right -of -w reated by the realignment of
Davis Road.

COUNTY OF RIVERSIDE
SUMMARILY VACATING A PORTION OF DAVIS ROAD, IN THE LAKEVIEW AREA

(THIRD SUPERVISORIAL DISTRICT)
WHEREAS, the hereinafter described portion of Davis Road, as shown on Record of
Survey, recorded in Book 99, Pages 61 through 90, inclusive, records of the County Recorder,
Riverside County, California, and,
WHEREAS, the hereinafter- described portion of Davis Road is not necessary and is
excess interest; now, therefore;
BE IT RESOLVED, DETERMINED AND ORDERED by the Board of Supervisors of
the County of Riverside, State of California, in regular session assembled on
October 17 , 2000, as follows:
1. Pursuant to Section 8334(a) of the Streets and Highways Code that the hereinafter
described portion of Davis Road is an excess interest not required for highway purposes and
is hereby summarily vacated:

EXCEPTING AND RESERVING from the vacation an easement
for any existing public utilities and public service facilities, together
with the right to maintain, operate, replace, remove or renew such
facilities, pursuant to Section 8340 of the Streets and Highway Code.
2. That the herein - described portion of Davis Road is unnecessary for present or
prospective public use, including use as a non - motorized transportation facility.
BE IT FURTHER RESOLVED, DETERMINED AND ORDERED that the Clerk of this
Board shall cause a certified copy of this resolution to be recorded in the Office of the County
Recorder of the County of Riverside, California.

EXHIBIT A
Those portions of the westerly 30 feet of Section 5 and the easterly 30 feet of
Section 6, Township 4 South, Range 2 West, Rancho San Jacinto Nuevo in the County of
Riverside, State of California described as follows:
Commencing at the southwest corner of said Section 5, Township 4 South,
Range 2 West, Rancho San Jacinto Nuevo as marked by a 2" brass cap stamped "MWD LS
5113" as shown on Record of Survey filed in Book 99, pages 61 through 90, inclusive of
Record of Surveys of said County; thence along the centerline of the right of way now
known as Davis Road (60 feet wide) declared a Public Highway on April 8, 1896 in Book
1, page 56 of Road Records, minutes of the Clerk of the Board of Supervisors of said
County N 00° 15' 39" E 421.69 feet; thence N 89° 44' 21" W 30.00 feet to a point on the
westerly right of way line of said road, said point being the POINT OF BEGINNING and
the beginning of a nontangent curve concave easterly having a radius of 1530.00 feet, a
radial line to said beginning bears N 89° 44' 21" W; thence leaving said westerly right of
way line, southerly along the arc of said curve 406.35 feet through a central angle of 15° 13'
01" to the southerly line of that certain parcel of land conveyed as Parcel 6 to the State of
California by Grant Deed recorded May 22, 1981 in Book 1981, page 94057 of Official
Records of said County, said southerly line of Parcel 6 also being the northerly line of that
parcel of land conveyed to the County of Riverside by Deed recorded February 24, 1913 in
Book 381, page 17 of Deeds, Records of said County; thence along said northerly line
N 89 59' 13" W 23.64 feet to the southwest corner of said Parcel 6 as marked by a 1" I.P.
with plastic plug tagged "LS6799" as shown on said Record of Survey; thence along the
north line of the south 20.00 feet of said Section 6 N 89° 58' 18" W 30.00 feet to the
westerly right of way line of said road; thence along said westerly right of way line N 00°
IS' 39" E 401.81 feet to the POINT OF BEGINNING.
