JUSTIFICATION:
This vacation request is to prevent public access to Friends of the Desert
Mountains conservancy. The vacation of Raindance Road and Canal Road will not
landlock parcels within Parcel Map 7444. Access to parcels within Parcel Map
J, 7444 has been provided by private reciprocal easements within Raindance Road
W� and Canal Road.
(/} Per the Fire Department the owners have executed an agreement pertaining to the
installation of gates. This agreement is attached hereto and made a part of the
vacation of Raindance Road and Canal Road.

10 WHEREAS, the herein -after described 30 foot road easements were dedicated to the
11 County per Parcel Map 7444, recorded in Book 46, Pages 39 through 40, records of the
12 County Recorder, Riverside County, California, and,
13 WHEREAS, the offer of dedication for said 30 foot road easements have not been
14 accepted by the County of Riverside; and,
15 WHEREAS, said 30 foot road easements are not part of the circulation element of the
16 General Plan, and that this vacation will not eliminate access to any parcels, and are excess
17 right -of -way, and not required for public street or highway purposes; now, therefore,
18 BE IT RESOLVED, DETERMINED AND ORDERED by the Board of Supervisors of
19 the County of Riverside, State of California, in regular session assembled on
20 November 14 , 2000, as follows:
21 1. That the right to accept the herein -after described portion of said 30 foot road
22 easements are excess right -of -way not required for public street and highway purposes and

As a condition of approval of the vacation of Raindance Road and Canal Road, in the

Should a gated entrance to the project site be proposed the following shall apply:
Section 1. The gate entrances shall be at least two feet wider than the existing roadway.
Section 2. The gate(s) shall be installed with a Knox Security System lock.
