This vacation will allow the County to terminate maintainance of the street and will remove the County's liability. A portion of the existing street which connects to Clay Street will remain in place and will be used for ingress and egress into the development. The portion of the road within the shopping center and theater complex will be removed. The project is designed to internal circulation and access via a common parking area which incorporates the vacated right of way. avid E. De ty 1 2 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I Board of Supervisors RESOLUTION NO. 99-187 GENERAL VACATION OF DE ANZA PLAZA DRIVE IN THE PEDLEY AREA (AB99002) (SECOND SUPERVISORIAL DISTRICT) County of Riverside WHEREAS, pursuant to Street and Highways Code Section 8321, a petition has been filed with the Board of Supervisors of the County of Riverside, State of California, requesting the general vacation of De Anza Plaza Drive which is located in the Pedley area of the County of Riverside; and, WHEREAS, on October 19 , 1999, the Board of Supervisors of the County of Riverside duly and regularly adopted Resolution No. 98 -186, giving notice of intention to vacate De Anza Plaza Drive; and, WHEREAS, Resolution No. 99 -186 has been duly published, posted and mailed pursuant to the provisions of the Street and highways Code; and, WHEREAS, pursuant to Streets and Highways Code Section 2381 the Board of Supervisors of the County of Riverside has determined that De Anza Plaza Drive as described hereon is not useful as a non- motorized transportation facility; and, WHEREAS, a public hearing has been conducted and the Board of Supervisors of the County of Riverside has head all of the evidence offered by all persons interested in the matter; and, WHEREAS, the Board of Supervisors of the County of Riverside has determined that the highway described herein is excess right -of -way and unnecessary for present public use; now therefore, 11/9/99 . 7.1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 II Reso!ution No. 99-187 BE IT HEREBY RESOLVED, DETERMINED AND ORDERED by the Board of Supervisors of the County of Riverside, State of California, in regular session assembled on November 9 , 1999, that pursuant to Section 8334(a) of the Streets and Highways Code, the County of Riverside hereby vacates De Anza Plaza Drive, being in the County of Riverside, State of California, more particularly described as follows: SEE LEGAL DESCRIPTION AND PLAT ATTACHED HERETO AS EXHIBIT "A" AND MADE A PART HEREOF EXCEPTING AND RESERVING FROM SAID VACATION: (a) An easement for any existing public utilities and public service facilities, together with the right to maintain, operate, replace, remove, or renew such facilities, pursuant to Section 8340 of the streets and Highways Code. (b) An easement in favor of the public for pedestrian and vehicular ingress and egress for the existing and future street and highway in, upon, through, and over the street or highway being vacated, pursuant to Streets and Highways Code Section 8340 (b). BE IT FURTHER RESOLVED, DETERMINED AND ORDERED that the Clerk of this Board shall cause a certified copy of this resolution to be recorded in the Office of the Recorder of Riverside County, California.
