rs0159_063-064SURVEYOR'S NOTE: Discrepancies in the underlying deeds used to establish the subject property shown hereon were discovered during the course of this survey, specifically, 1) ambiguity in the alignment of Turner Street, 2) on overlap of approximately 4 feet t with the subject property and an adjoiner's property to the northwest and 3) and a shortage of approximately 4 feet t within the subject property. Turner Street: 1. Several deeds refer to the NW'ly and SE'ly right-of-way of Turner Street as having a bearing of S36'30'W. MS 17/97 also shows the some bearing (N36'30'E) along the portion of the centerline of Turner Street shown thereon. All the streets, shown on said Mop, running SW'ly to NE'ly ore shown to be perpendicular with Grand Avenue which has a bearing of S53'30"E. Other deeds, including the grant deed in Book 1952 Page 200 which granted Turner Street to the County of Riverside (see paragraph 6 below), have an angle point in the alignment of Turner Street. 2. PM 07/54 depicts Turner Street from the intersection of Turner Street and Brightman Avenue to Grand Avenue without a bearing and with a width of 50'. It also depicts Turner Street from Brightman Avenue to the intersection of the NE'ly line of said MB 17/97 with a bearing and distance of N36'30'E 125.06'. It is unclear whether or not it was intended to have the some bearing (N36'30'E) as shown on MB 17/97 along this portion or to be perpendicular with Grand Avenue as described above. If the latter were the case, Turner Street would have a bearing of N36'28'20"E to be perpendicular with Grand Avenue (S53'31'40"E) as shown on said PM 07/54. For this survey, the record bearing and distance shown on MB 17/97 was held (L9) for the starting point of Turner Street. 3. PM 07/54 shows a distance of 66' from the NW'ly line of Turner Street to the NW'ly line of Lot 18 of Block D per MB 06/296 (San Diego County). These appear to be parallel. Note: MB 06/296 does not show bearings or distances only areas nor does it show Turner Street. This 66' distance is consistent with the deeds of the properties within Lot 18 on the NW'ly side of Turner Street. 4. PM 07/54 also shows a found 2" iron pipe that was accepted a$ the N'ly comer of said Lot 18. Holding the 66' distance shown on PM 07/54, the calculated distance from this corner to the intersection of the centerline of Turner Street (25' half width) with the SW'ly line of Grand Avenue is 91.00'. A prolongation of Turner Street from the intersection of the centerline of Turner Street with the Northeriy subdivision boundary of MB 17/97 as shown on PM 07/54 using the original bearing shown on MB 17/97 of N36'30'E results in the distance of 91.00' described above as being 95.08'. Establishing Turner Street using the perpendicular bearing of N36'28'20"E described above results in the 91.00' distance as being 94.84'. (SEE SHEET 2, DETAIL A, NOTES 1 & 2). 5. The 2" iron pipe described above at the N'ly corner of Lot 18 was searched for by this survey and not found. This position was established holding the 412.8' record deed distance shown on PM 07/54 from the N'ly corner thereof. 6. The grant deed in Book 1952 Page 200, Recorded August 1, 1956, granted Turner Street to the County of Riverside. The legal description in said deed begins at the intersection of the centerline of Turner Street and the southerly boundary of Rancho La Laguna as shown on both MB 17/97 and PM 07/54 and continues N36'03'30E 450.69 feet to a point on a line lying 91 feet SE'ly of the NW'ly line of Lot 18, measured a right angles. Thence N36'32'30" 165.0 feet (more or less) to the NE'ly line of Lot 18 (Also being the SW'ly sideline of Grand Avenue). Subject Property & Adjoiner Deeds - Discrepancy. 10. Per the deed descriptions in Book 2459 Page 53 (DD2) and Book 2597 Page 189 (DD3), which describes a portion of the NW'ly 181.80' feet of the subject property shown hereon, the line coincident between them lies 115.00 feet SE'ly from the SE'ly line of Turner Street. 11. Per the deed description in BK 2459/53, the course described as "North 36'30' East, a distance of 594.75 feet to a point on the Southwesterly Line of Grand Avenue" has an actual calculated distance of 591.09 feet. This distance was held hereon. 13. This survey is in disagreement with the procedure used on Certificate of Parcel Merger No. 01894, recorded 10/17/2016 as File No. 2016-0453656 to establish the course described as N55'10'30"W 111.13' along the panhandle in the NW'ly corner of the subject property (L11 hereon), it appears to have been shortened from the record distance of 115.00 feet per the underlying deeds to accommodate the 4 -foot discrepancy described in paragraph 12, It's the opinion of this surveyor that this distance should have been held at 115.00 feet considering this does not appear to be where the discrepancy exists.
